Community Board 9 & Districe Manager Pearl Miles, Crimes!
This document is set up with a short introduction to each of the *seven categories of violations, the charts that depict the details and occurrences of these violations, followed by the laws that have been violated by CB9 and Pearl Miles. The seven categories are Agenda, Committee, FOIL, Minutes, Opposition, Rules and Speaking. Please just click on a category and go to that section.
*Please note these are not the only violations on record, however, these categories represent the repeated occurrences and shows intention on the part of Community Board 9’s Executive Board and Pearl Miles to circumvent the law.
Violation: Agendas for General Community Board Meetings
Brooklyn’s Community Board 9 is in violation of their own Bylaws by not conducting Executive Committee meetings to set an agenda, by not giving notification to the community about Executive Committee meetings, by not taking minutes of these meetings and not providing them to the public, and by not making the agenda available to the public before a general meeting.
CB9’s Bylaws direct CB9 executive committee to meet prior to a CB9 general meeting to create an agenda. The Open meetings laws requires public notification of 7 days prior for its meetings. Thus agenda items would be made available to the public for input and review before CB9’s general meeting, if they were abiding by the law.

Brooklyn Community Board 9 Bylaws
Article 8.6 This committee shall meet prior to the meeting of the Board to set an agenda. Article 8.7(e) The committee chairman/woman shall keep minutes of each committee meeting and shall deliver same to the Board Secretary.

Violation: Lack of Appointment of residents on Committees
Brooklyn Community Board 9 is refusing to allow residents on its committees and has created a new rule, where if a person isn’t on the committee he/she may not speak or vote on any issue.

Another way that has been employed to reduce participation and empowerment of the residents to
determine what happens in their community is by not scheduling regular committee meetings, not providing the community with minutes of its meetings and by not making the meetings public.

§ 2800. i. Community boards.
i.. It may include on such committees persons with a residence or significant interest in the community who are not members of the board,

Article 8.2. Non-board members shall be appointed to committees by the Chairperson of the Board and/or the committee chairperson..
Article 8.3. Each committee shall act by a majority of members appointed by the board present. Appointed members may be appointed to committees at any time during the year,
Article 8.7 (c) Committees shall encourage the participation of non-Board members on committees including representatives of local interested organizations. Non-Board members shall be appointed to a committee
Brooklyn Community Board 9 is in violation of the New York City Charter, Open Meetings Law, and Brooklyn Community Board By-laws. The standing committee meetings of Brooklyn Community Board 9 have been regularly held in private without notification to the public. In 22 of 52 of the meetings known to occur between January 2014 and February 16, 2015, the public was not given notice of the meeting. In 42 of these 52 known meetings, the minutes have not been made available to the public. The minutes should include the names of the members of the committee, the attendance, and a record of the vote tally, if there is a vote.
Brooklyn Community Board 9 By-laws require that standing committees meet 5 times per annum. The Education Committee, the Health and Social Services Committee, the Public Safety Committee, the Parks, Recreation and Cultural Affairs Committee, the Transportation Committee, and the ULURP Committee, 8 committees in total were all in violation of the By-laws in 2014.
Note: No committee meetings were publicly posted to the Brooklyn Community Board 9 website from March 4, 2013 to March 2, 2014. Minutes of the Board meetings indicate that the some of these committees were meeting during that time period, despite the lack of public notice. Also, Minutes of the Board meetings indicate that some committees continued to meet without public notice in 2014.

Violation: Non-Compliance with Freedom of Information Requests FOIL
Brooklyn Community Board 9 District Manager Pearl Miles has not been in compliance with Freedom of Information Law. She regularly fails to respond to and fulfill FOIL requests submitted by the community. As a result, several community members have had to file Article 78s. This pattern of disobedience to the law is indicative of a conscious effort on her part to prevent the community from having full disclosure and understanding of the workings of CB9.
With regard to the voting record of March 25, 2014, Pearl Miles states in her affidavit that the box containing the voting record was lost on March 25, 2014. However, in her FOIL request response dated October 31, 2014, ( 2 months after the first request was submitted), she states that she would be able to provide the records within 3 weeks. If she knew that the voting records were lost in March of 2014, why would she say that she could provide them? Ultimately she never provided the records, explained that they were lost, or informed the requester that she could not comply with the FOIL request.

§87. Access to agency records.
2. Each agency shall, in accordance with its published rules, make available for public inspection and copying all records,

within five business days of the receipt of a written request for a record reasonably described, shall make such record available to the person requesting it, deny such request in writing or furnish a written acknowledgment of the receipt of such request and a statement of the approximate date, which shall be reasonable under the circumstances of the request,
if circumstances prevent disclosure to the person requesting the record or records within twenty business days from the date of the acknowledgement of the receipt of the request, the agency shall state, in writing, both the reason for the inability to grant the request within twenty business days.
Violation: Public Meeting Minutes
Brooklyn’s Community Board 9 is in violation of the New York City Charter, Freedom of Information Law, Open Meetings Law, and their own By-laws for failing to present the community with the minutes of public meetings in a timely manner, and in some instances, Community Board 9 failed to provide any minutes at all. The NYC Charter places this responsibility upon the District Manager and staff, thus, it is clear that Pearl Miles has failed in her duties and responsibilities.
Additionally, the minutes have been repeatedly depicted wrongly, omitted important pieces of information, leaving out people’s statements, i.e. the minutes of September 23, 2014, failed to include that Pearl Miles, yelled at the community to “Shut Up!”, “Shut Up!”, “Shut Up!” Also it failed to state that Dwayne Nicholson never reported the vote results, and Pearl Miles gave a false statement concerning the voting record, refusing to recognize two yes votes and reporting them as absent!
Furthermore District Manager Pearl Miles is also required by the above mentioned laws, to keep a public record of any resolutions passed by the board and the voting records of its members and make them available to the public upon request.

Opposition to the Up zoning and Change in Zoning Designation of Empire Boulevard
In Pearl Miles affidavit, she indicates that the whole opposition to the way in which CB9 has conducted business, heard from the public, created rules and procedures is just Alicia Boyd. That there is no support from the community in regards to opposing Empire Blvd from being up zoned etc… thus the need to demonstrate the will of the people with behaviors and actions of the community.
In June 2014, Department of City Planning Brooklyn Office Director Winston Van Engel stated at a public meeting that if he could not achieve community consensus around the rezoning study, that City Planning would not move forward with the study for rezoning.
However, after clear demonstration of the lack of consensus within community district 9, as shown in the table below, City Planning was still moving forward with the study in October 2014. Alicia Boyd submitted several FOIL requests, on November 10, 2014 and Jan 15, 2-15 to City Planning to ascertain the intentions of City Planning and determine what decisions City Planning was making at the time. still outstanding!
